Uncharted 2 Game Night – 3/17/11 Video Highlights
Here is a just released, narrated trailer featuring a mix of “moving water colored stills,” as well as new gameplay footage for Dungeon Siege III. Square Enix and Obsidian Entertainment’s Dungeon Siege III is slated to have a May 31st release date in the US. Read more about this greatly anticipated game in our post here . Finally we get to see some of the games coming to the NGP in glorious HD. This, I’m sure, is just a taste to come as time goes on. Even with the PSP we didn’t see some beautiful games until a few years in when companies like Square Enix pumped out the powerhouse Crisis Core and I’m sure this time we will not have any size limitations holding the games back.

Highlights First of all, these highlights are usually going to be dealing with the US/NA update and not so much on the EU update, but either usually have the same big items anyway. With that said, you can now download the Assassin’s Creed II Deluxe Edition directly to the console, and, with that, PlayStation Plus subscribers get the free 1 hour demo of the full game. If you haven’t tried any of the AC games, and have PS+, I think it’s definitely worth a shot. Other games that released include the UnderGarden and Bionic Commando: Rearmed 2. If you want to check out demos, there are two; Fight Night Champions and Trinity: Souls of Zill O’ll. You can also pick up the import version of Capcom’s Mega Man 2. There are a few sales going on, especially Blue Toad Murder Files. If you haven’t picked that up, you can get it for about $10 off now. As far as DLC goes, there isn’t anything noteworthy, apart from maybe ModNation Racer’s Helghast mod and kart and the Clash’s London Calling for Rock Band 3 if you’re into that kind of music. There are also a couple dynamic themes (Billowing Clouds sounds like it might be pretty cool), as well as a few that are new to Canada as well. According to Geohot and fail0verflow’ s web sites, Sony has served them with law suits yesterday evening. PDF copies of three different documents, linked to from their web sites, as well as at the bottom of this post, reveal that Sony Computer Entertainment America (SCEA) is seeking a TPO (temporary restraining order) against both George “geohot” Hotz and fail0verflow because of “their violations of the Digital Millennium Copyright Act (“DMCA”).” failOverflow has since removed any and all information regarding the circumvention technology regarding Technological Protection Measures (TPM), or codes for the PS3 hardware, however geohot still links to his old front page with some informaton and download links. Geohot was also ordered to “deliver for impoundment any computers, hard drives, CDroms, DVDs, USB stick, and any other storage devices on which any Circumvention Devices are stored in Defendant Hotz’s possession, custody or control.” On January 11, 2011, Plaintiff Sony Computer Entertainment America LLC (“SCEA”) filed a Complaint against Defendants George Hotz (“Defendant Hotz”), Hector Martin Cantero, Sven Peter and Doe Defendants 1 through 100. SCEA has alleged that each Defendant, individually and in concert with the other Defendants, has: (1) circumvented effective technological protection measures (“TPMs”) employed by SCEA to protect against unauthorized access to and/or copying of SCEA’s proprietary PlayStation®3 computer entertainment systems (“PS3 System”), and other copyrighted works; and (2) trafficked in circumvention technology, products, services, methods, codes, software tools, devices, component or part thereof, including but not limited to the Elliptic Curve Digital Signature Algorithm (“ECDSA”) Keys, encryption and/or decryption keys, dePKG firmware decrypter program, Signing Tools, 3.55 Firmware Jailbreak, and/or any other technologies that enable unauthorized access to and/or copying of PS3 Systems and other copyrighted works. SCEA has alleged that Defendants have violated the Digital Millennium Copyright Act (“DMCA”) 17 U.S.C. §1201, et seq.; the Computer Fraud and Abuse Act (“CFAA”), 18 U.S.C. § 1030, et seq.; and has alleged contributory copyright infringement arising out of the Copyright Act, 17 U.S.C. §501, et seq.; as well as related state and common law claims for violation of the California Comprehensive Computer Data Access and Fraud Act, Cal. Penal Code § 502, et. seq., breach of contract, tortious interference with contractual relations, trespass and common law misappropriation. The following is some great information from the documents explaining exactly what the TPMs are, as well as what the hackers did that was illegal. A. SCEA’s PlayStation®3 Computer Entertainment System And Its Technological Protection Measures All genuine PS3 Systems are manufactured with technological protection measures that effectively control access to the PS3 System and prevent unlicensed or copied software from playing on the PS3 System. The PS3 System is designed to run multiple levels of authorized, encrypted code in one or more sequences. Each level features TPMs, which control access, encrypt and decrypt code, and authenticate signatures to enable access to the files within the code. One purpose of the PS3 System’s TPMs is to prevent users from playing illegally copied, pirated games. To that end, every file authorized to run on the PS3 System contains an authentic digital signature. SCEA generates each digital signature using a pair of electronic keys (“Keys”). The PS3 System verifies each signature using one of those Keys, which is encrypted and embedded in the system. The other Key is held by SCEA; it is not distributed and cannot be located anywhere in the PS3 System’s code or hardware, or the code of any authorized video game. The PS3 System will not execute a file unless that file contains an authentic digital signature. Unauthorized or unlicensed video game discs (such as those burned from genuine game discs) do not have an authorized signature code. Accordingly, a normally functioning PS3 System will not run those pirated video games. The PS3 System also utilizes access control and encryption. Those TPMs prevent, restrict or otherwise limit access to certain sections of the PS3 System software and hardware. As a result, the TPMs ensure that the PS3 System functions in a safe and reliable manner. They also protect the encrypted firmware, encrypted digital signature Keys and other encrypted Keys that are stored within the PS3 System. Because the PS3 System and its code are protected by these TPMs, users can neither access nor read the signatures or the Keys, and therefore cannot use those elements to gain access to the System to run a pirated video game. Using the types of TPMs discussed above, the PS3 System allows only the operation of legitimate, authorized and approved software that is licensed for distribution in the region or geographical territory of the console’s sale. By taking these precautions, SCEA has been able to protect its exclusive rights to copy, sell, distribute and manufacture video games. In addition, SCEA has been able to protect its substantial investment – and the investment of third-party videogame companies – in the development, creation, and distribution of the PS3 System and compatible video games. B. SCEA’s Copyrights And Copyright Licenses SCEA develops and publishes its own interactive entertainment software video games for the PS3 System. SCEA has invested and continues to invest substantial time, effort and expense in the design, development, testing, manufacturing and marketing of its video games. Those games are highly creative and SCEA has obtained copyright registrations to protect them. For example, SCEA owns valid copyright registration for the following video game software: Ratchet & Clank Future: Tools of Destruction (Copyright No. PA 1-616-055); Resistance 2 (Copyright No. PA 1-619-506), and Uncharted Drake’s Fortune (Copyright No. PA 1-611-286). All PlayStation3 video games are programmed with computer code, referred to herein as PlayStation3 Programmer Tools (“PS3 Programmer Tools”), that authenticate authorized video game software and facilitate interaction with the central processing unit and microprocessors in the PS3 System. A video game whose program does not incorporate the PS3 Programmer Tools cannot be played on the PS3 System. The PS3 Programmer Tools are also incorporated within the PS3 System firmware. SCEA is the licensee of the registered copyright for the PS3 Programmer Tools (Copyright No. TX0007208564) and is authorized to sublicense its rights to use, copy and distribute the Tools to third party video game developers and publishers. SCEA also offers licenses to third parties to develop interactive entertainment software products for the PS3 System. These licensees are authorized to use proprietary PlayStation®3 technology to develop video game software for the PS3 System and to publish and distribute their video games. SCEA receives royalties on each PlayStation®3 video game manufactured pursuant to its licenses with third party publishers. C. Defendants’ Illegal Activities Since the release of the PS3 System in 2006, software hackers have attempted to write code to run unauthorized software on SCEA’s gaming system. Until a few days ago, the efforts of these hackers were largely thwarted by the TPMs that secure the various levels of the PS3 System. In late December 2010, a hacking group called FAIL0VERFLOW discovered a way to access certain (but not all) levels of the PS3 System by circumventing the corresponding TPMs. At that point, hackers were given the tools to run unauthorized and pirated software on the PS3 System. Building on FAIL0VERFLOW’s work, Defendant Hotz unlawfully gained access to a critical level of the PS3 System by circumventing the corresponding TPMs. In early January 2011, Hotz publicly distributed the circumvention devices necessary to access that level, providing them to the public via the Internet and releasing software code that will allow users to run unauthorized or pirated software on the PS3 System. Unless this Court enjoins Defendants’ unlawful conduct, hackers will succeed in running and distributing Circumvention Devices that run pirated software on the PS3 System. Sony Files Suits Against Geohot and fail0verflow

Yesterday the group behind the Homebrew Channels on the Wii announced live with a slide presentation at 27c3, that they have discovered the private keys for the PS3. What does this mean? Custom firmware? Piracy? Homebrew? There is a large potential for good and bad with this. Obviously the bad starts with piracy. We all know it will happen but thats not the worst of it. With these keys you can also expect to see online multiplayer cheaters with aim bots and more, trophy hackers and possibly even viruses. The good that comes out of this will be emulators, linux, mkv support and things of this nature. In short, these keys allow software to be designed directly for the PS3 just as any dev would do it. No custom firmware will be required to run this software, no jailbreaking and no hacking. Simply install the firmware and the PS3 will treat it as signed software from Sony itself. The steps taken against Sony and the PS3 (the group is making it personal by saying Sony is a failure on multiple levels) have indeed put the system and software at risk. It is now the most open platform on the market today. Sony is very limited as to its responses as a firmware update will not correct this. The only things they can do is on the manufacturing level with new PS3′s that hit the shelves and they can whitelist all existing PS3 software but neither of these options are fullproof, both are expensive and time consuming. Its even possible that Sony will not be able to detect this on their end. Only time will tell how this affects the PS brand. In this post David Scott Jaffe the Co-Founder of Eat Sleep Play and the Co-Director/Co-Lead Designer of Twisted Metal 3 tells us what the team is up to and even answers questions from all over the internetz that fans of the game have asked. Also if you happen to WOO him in some way by posting a response you might be able to win your self an autographed “Sweet Tooth” action figure from the team.They are going to be giving away 10 of them. Anyone else like this guy? I think he’s a straight shooter, he doesn’t come of as an arrogant arse to me. He goes out and just says what needs to be done or is going to be done in a straight forward way. Some people might hate it but I have to say that I appreciate it.

Twisted Metal Q/A with David Scott Jaffe
The studio that started the Call of Duty phenomenon fell to pieces earlier this year with the firing of its co-founders and the following mass exodus of pissed off Infinity Ward employees. With enough money, you can recover from that. And when you’re Activision Blizzard, you can put Infinity Ward back together again. You can get over it. Activision’s owner claims it has, according to the Financial Times . “We have reconstructed Infinity Ward,” said chairman and CEO Jean-Bernard Lvy of Vivendi, the majority owner of the mega-publisher. “We have been very happy with the way we have been able to reconstruct it.” Not that Vivendi and ActiBlizz need them! Lvy boasts that Black Ops developer Treyarch has outperformed the old Infinity Ward with its latest game. Activision did promise “ Ultimately, Infinity Ward will rise from the ashes ” not long after aggressively hiring new talent for the embattled studio. We’re sure they’ll be wrapping up Modern Warfare 3 any day now. Bobby Kotick is of course all about the money, he cares not for the games nor what goes into them, he only cares about the money he can extract….or “farm” from us players. But Infinity Ward has taken a huge loss this year due to lead developers quitting and founding new companies, it’s not just the developers leaving the company but other key players that develop games for us to enjoy as consumers. Personally I think this is a huge blow to Infinity ward, and it’s all Bobby Koticks fault, as I said he’s more concerned about making a quick buck, not so much concerned with the consumer….the PLAYERS….the people who buy ActiBlizz games. There is a movement on the official Playstation Forums to boycott Bobby Kotick/Actiblizz games, sadly the post has been buried and forgotten…..despite my attempts to keep the topic floated. Now-A-Days it seems that the main focus for the major developers is to develop a game that ‘nets’ the most immediate revenue and to subsequently “forget” about the game and move on. I don’t know about the rest of you but I miss the good-ol-days of gaming where it used to be about the games….not the companies that developed the games. For the gaming veterans out there like myself, do you remember the old days of the NES? Do you remember who made the game, or do you remember the game itself? Take Festers Quest for instance…a TERRIBLE game by today’s standards, but all in all you don’t remember that it was Sunsoft that dropped the ball on a developer standpoint, you just know that Fester’s Quest sucks some serious……well it just sucks. My point is that over the past 20-some-odd-years I think most of us gamers have lost focus on the big picture, and I think its the age of entitlement that has ruined gaming for us old farts. In closing, as I said I think that the modern age of “entitlement” has ruined modern gamers, as a gamer from the 80’s I have seen the industry grow in leaps and bounds, and it still fails to satiate the modern gamer because the modern gamer is spoiled beyond belief. In closing I think as gamers some of us have lost touch and become to greedy in our demands, and with our complaints have caused rifts in companies such as Infinity Ward. You may think that we have no influence in the goings-on of these companies, but in reality, customer feedback is the “word of god” But seriously, we only have ourselves to blame for this “reconstruction” and if the next installment of Call of Duty sucks….well its our fault because we complained and griped about the current development team and demanded new talent, and the new team who has no clue what we want as a community. So when the next COD sucks we only have ourselves to blame, because in the end these companies really do listen to us.
